These Terms and Conditions (“Terms”) apply to the use of ephemeralbenediction.com (“Website”) and to purchases made through the Website.

The Website is operated by Hugo Hallist.

By using the Website or placing an order, you agree to these Terms. If you do not agree to these Terms, you should not use the Website or place an order.

Nothing in these Terms affects any mandatory rights you may have under applicable consumer protection law.

You may use the Website only for lawful purposes and in accordance with these Terms.

You must not use the Website in any way that:

* breaches any applicable law or regulation;

* infringes the rights of Hugo Hallist or any third party;

* interferes with the proper operation, security, or availability of the Website;

* attempts to gain unauthorised access to the Website, its systems, or related services;

* introduces viruses, malware, harmful code, automated scraping tools, or other disruptive technologies;

* copies, extracts, republishes, or exploits Website content without permission.

Hugo Hallist may modify, suspend, restrict, or discontinue the Website, or any part of it, at any time. Hugo Hallist is not liable for any unavailability, modification, suspension, or discontinuation of the Website, except where liability cannot be excluded under applicable law.

3. Products and Artwork

The Website may display and sell original artworks, prints, photographs, and other physical art-related items.

Hugo Hallist takes care to describe and display artworks accurately. However, colours, tones, textures, scale, and appearance may vary depending on your screen, browser, device settings, lighting, and other technical factors. Any measurements, descriptions, and images are provided as accurately as reasonably possible.

Minor variations in colour, texture, finish, or appearance do not necessarily mean that an artwork is defective or misdescribed.

Hugo Hallist may correct errors, inaccuracies, or omissions on the Website at any time, including after an order has been placed. If a material error affects your order, Hugo Hallist may contact you to offer cancellation, correction, or another appropriate solution.

4. Orders and Acceptance

Placing an order means that you offer to buy the selected item under these Terms.

An order is accepted only when Hugo Hallist confirms acceptance of the order by email. Hugo Hallist may refuse or cancel an order if:

* the item is unavailable;

* the item has been incorrectly priced or described;

* payment is not received or is reversed;

* fraud, misuse, or unauthorised activity is suspected;

* shipping to the requested destination is not possible or is not commercially reasonable;

* Hugo Hallist is legally unable to fulfil the order.

If an order is cancelled after payment has been received, Hugo Hallist will refund the amount paid, unless another lawful remedy applies.

5. Prices, Taxes, and Payment

Prices are shown in [EUR].

Unless expressly stated otherwise, prices do not include customs duties, import VAT, brokerage fees, local taxes, handling fees, or other charges imposed by the destination country.

The total price shown at checkout may include the item price, applicable taxes, shipping charges, and any other charges collected at checkout. Charges not collected at checkout may still be payable by the buyer to customs authorities, carriers, or other local authorities.

Payment is due at checkout. Orders will not be dispatched until payment has been received in full.

Payments may be processed by third-party payment providers. Hugo Hallist does not store full payment card details on the Website.

6. Shipping and Delivery

Hugo Hallist ships using UPS or another tracked carrier where available.

Free standard shipping may be offered to selected destinations where UPS or another available carrier can deliver. Hugo Hallist reserves the right to refuse, cancel, or request additional shipping costs for destinations that are restricted, unusually expensive, unsafe, remote, or not practically serviceable.

Delivery estimates are provided for guidance only and are not guaranteed. Delays may occur because of customs, carrier disruption, local postal issues, weather, strikes, public holidays, incorrect address information, or other circumstances outside Hugo Hallist’s control.

The buyer is responsible for providing a complete and accurate delivery address. Hugo Hallist is not responsible for delays or failed deliveries caused by incorrect or incomplete address information supplied by the buyer. If an order is returned because of an incorrect address, failed delivery attempt, or failure to collect the package, additional shipping costs may apply.

Risk in the goods passes to the buyer when the goods have been delivered to the buyer or to a person designated by the buyer, unless mandatory consumer law provides otherwise.

If the buyer arranges their own carrier independently, risk may pass when the goods are handed to that carrier, to the extent permitted by law.

7. Customs, Import Duties, and Local Charges

International orders may be subject to customs duties, import VAT, brokerage fees, handling fees, or other charges imposed by the destination country.

These charges are the buyer’s responsibility unless expressly stated otherwise at checkout. Hugo Hallist cannot predict or control these charges and is not responsible for delays caused by customs authorities.

The buyer is responsible for complying with local import rules and responding to any customs requests, forms, or procedures required in the destination country.

If a package is refused, unclaimed, returned, delayed, or destroyed because the buyer does not pay required import charges or does not comply with customs requirements, Hugo Hallist is not responsible for any resulting loss, delay, or additional cost, except where mandatory law provides otherwise.

8. Damaged, Faulty, Incorrect, or Lost Items

If an order arrives damaged, faulty, incorrect, or appears to be lost, the buyer should contact Hugo Hallist as soon as possible at ephemeralbenediction@gmail.com.

For damaged items, the buyer should provide:

* the order number;

* photographs of the damaged item;

* photographs of the outer packaging;

* photographs of any inner packaging;

* a description of the issue.

The buyer should keep all packaging until the issue has been assessed, as the carrier may require inspection.

Hugo Hallist will review the issue and, where appropriate, work with the carrier to investigate. Depending on the circumstances and applicable law, Hugo Hallist may offer a repair, replacement, refund, partial refund, or another suitable remedy.

Nothing in this section limits any statutory rights you may have if an item is damaged, faulty, misdescribed, or not delivered.

9. Right of Withdrawal and Returns

If you are a consumer in the Netherlands, the EU, or the EEA buying online, you may have a statutory right to withdraw from the purchase within 14 days without giving a reason.

For physical goods, the withdrawal period usually begins on the day after you, or a person designated by you, receives the goods.

To exercise the right of withdrawal, you must inform Hugo Hallist of your decision to withdraw within the withdrawal period by contacting:

You may use the model withdrawal form below, but you are not required to use it.

If you validly withdraw from an eligible purchase, you must return the item without undue delay and no later than 14 days after informing Hugo Hallist of your withdrawal.

The item must be returned in the same condition in which it was received. The buyer is responsible for handling the item carefully and for packaging it securely for return shipping.

Unless otherwise required by applicable law, the buyer is responsible for the direct cost of returning the item.

If an item is returned damaged, incomplete, used beyond what is necessary to inspect it, or otherwise reduced in value because of handling by the buyer, Hugo Hallist may deduct an appropriate amount from the refund, to the extent permitted by law.

Hugo Hallist may withhold the refund until the item has been received back or until the buyer has provided evidence of having returned the item, whichever occurs first.

Refunds will normally be made using the same payment method used for the original transaction, unless another method is agreed.

10. Exceptions to the Right of Withdrawal

The statutory right of withdrawal may not apply to all items.

To the extent permitted by applicable law, the right of withdrawal may not apply to:

* custom-made items;

* personalised items;

* items made to the buyer’s specifications;

* sealed items that are not suitable for return for health or hygiene reasons once unsealed;

* any other items excluded from withdrawal rights under applicable law.

Where an exception applies, this will be stated where reasonably possible before purchase.

This does not affect your statutory rights if an item is damaged, faulty, misdescribed, or not delivered.

12. Intellectual Property and Artwork Rights

All original artworks, photographs, images, text, designs, graphics, layouts, and other original content on the Website are owned by Hugo Hallist unless otherwise stated.

The content on the Website is protected by copyright and other intellectual property laws.

Buying an artwork, print, photograph, or other physical item gives the buyer ownership of that physical item only. It does not transfer copyright, moral rights, reproduction rights, licensing rights, merchandising rights, commercial-use rights, NFT/blockchain rights, or any other intellectual property rights unless expressly agreed in writing by Hugo Hallist.

Without prior written permission from Hugo Hallist, you may not:

* copy, reproduce, scan, photograph for commercial use, publish, distribute, or modify any artwork or Website content;

* sell, license, rent, transfer, or commercially exploit any artwork or Website content;

* create derivative works based on any artwork or Website content;

* use any artwork or Website content for advertising, merchandising, branding, publishing, or commercial display;

* mint, tokenise, or otherwise use any artwork or Website content in connection with NFTs, blockchain assets, or similar technologies;

* use, scrape, download, reproduce, or process any artwork, image, text, or content from the Website for machine learning, AI training, dataset creation, automated analysis, image-generation training, or similar purposes.

You may view the Website content for personal, non-commercial purposes only.

Hugo Hallist retains all applicable moral rights, including the right to be identified as the artist and the right to object to derogatory treatment of the work, where such rights apply.

13. Collages and Third-Party Source Material

Some collage works displayed on the Website may incorporate found, third-party, public-domain, licensed, or otherwise sourced materials.

Unless expressly stated otherwise, Hugo Hallist claims rights only in the original selection, arrangement, composition, editing, and original elements contributed by Hugo Hallist, and not in any underlying third-party material.

If you believe that any material on the Website infringes your rights, contact Hugo Hallist at [ephemeralbenediction@gmail.com] with enough information to identify the material and explain your claim.

14. Permission Requests

If you wish to use any artwork, photograph, image, text, or other Website content for any purpose beyond personal viewing, you must obtain prior written permission from Hugo Hallist.

To the fullest extent permitted by law, Hugo Hallist disclaims all warranties relating to the Website and its availability, performance, and content. This Website disclaimer does not affect any statutory rights you may have in relation to products purchased from Hugo Hallist.

18. Limitation of Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for intentional misconduct, gross negligence, fraud, death or personal injury caused by negligence, or any mandatory consumer rights.

To the fullest extent permitted by law, Hugo Hallist is not liable for indirect, incidental, special, punitive, or consequential losses, including loss of profit, loss of revenue, loss of data, loss of goodwill, business interruption, or other indirect losses arising from use of the Website or purchase of products.

For business customers, Hugo Hallist’s total liability arising out of or in connection with the Website, an order, or these Terms is limited to the amount paid by the customer for the relevant order, unless liability cannot be limited under applicable law.

For consumers, this limitation applies only to the extent permitted by mandatory consumer law.

19. Indemnification

If you use the Website unlawfully, breach these Terms, infringe intellectual property rights, or misuse Website content, you agree to indemnify and hold Hugo Hallist harmless from claims, losses, damages, costs, and expenses arising from your actions, to the extent permitted by law.

This section does not limit any mandatory rights you may have as a consumer.

20. Changes to These Terms

Hugo Hallist may update these Terms from time to time.

The version of the Terms published on the Website at the time of your order will apply to that order, unless a change is required by law or by a competent authority.

Continuing to use the Website after updated Terms are published means that you accept the updated Terms for future use of the Website.

21. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision will be treated as removed or modified to the minimum extent necessary.

The remaining provisions will continue in full force and effect.

22. Governing Law and Disputes

These Terms, the Website, and any purchases made through the Website are governed by the laws of the Netherlands.

Any disputes arising out of or in connection with these Terms, the Website, or any purchase made through the Website shall be submitted to the competent courts of the Netherlands.

If you are a consumer, this does not affect any mandatory rights you may have under the laws of your country of residence, including any right to bring a claim before another court where mandatory consumer law allows it.
